Terms of Use and Conditions

Portugal Trips detem uma plataforma que disponibiliza o serviço de transporte de passageiros na qualidade de operadora turistica, e outros serviços de reservas e actividades relacionada. Por favor, leia estes Termos de Utilização/Condições Gerais dos serviços para compreender o que está a reservar/adquirir. Deve ter 18 anos ou mais para fazer a reserva.

DEFINITIONS:
“Portugal Trips” transport service provider, touristic operator based in EU-PORTUGAL-LISBOA, registered in Portugal with RNAAT number nr 440/2016.
“Platform” means the Portugal Trips.com website or other websites, applications and booking tools operated by Portugal Trips.
“Driver” is the Driver who belongs/is in the dependence of Portugal Trips.
“User” is any person who visits/uses the Platform, any person who makes a booking through the Platform.
“Traveller” is any person who is going to use the transport services booked through the Platform (User or not).

SERVICES:
Portugal Trips provides booking and transport services to any Traveller legally entitled to do so/book. The Transport Service is supplied directly by Portugal Trips, with the possibility of using an independent driver service provider in specific situations. Portugal Trips provides the Booking Services to the Users free of charge, the User only pays for the Transport Service.

APPLICABILITY OF THE TERMS OF USE:
These Terms of Use apply (i) to all Booking Services and (ii) unless otherwise agreed including between the Traveller and the Driver. By using the Platform, the User agrees to be bound by these Terms of Use. If a User books the Transport Services for another Traveller, the User shall present these Terms of Use to the Traveller and ensure that the Traveller agrees to these Terms. By using the Platform on behalf of another Traveller, the User represents and warrants to Portugal Trips that the Traveller agrees to these Terms of Use and that the User has sufficient authority to make the booking on behalf of the Traveller. If a User or any Traveller represented by the User does not agree to the Terms of Use, the User may not use the Platform. The Platform is exclusively intended for persons over the age of 18. Any access or use of the Platform by anyone under the age of 18 is expressly prohibited. By accessing or using the Platform, the User guarantees to be over 18 years of age.

RESERVATION:
The Users make a binding booking of the Transport Services via Platform, selecting the place of departure, destination and date and time of departure, method of payment and confirmation of the booking. The User must also select the places on the itinerary to be visited and where the Driver will make a stop for this purpose during the journey. When booking, the User must identify at least one Traveller and any children under 12 years old to be able to participate in the trip and must provide the User’s email address and other details stated on the booking form or otherwise requested by Portugal Trips. Portugal Trips will confirm all bookings via email within 3 hours of confirmation of payment of the booking. Payment must be made using the debit/credit card registered on the booking, unless the User and Portugal Trips agree that the User pays in cash to the Driver.
If payment by card is selected and You do not pay for the Carriage Service immediately after the Booking Confirmation, Portugal Trips is entitled to cancel the booking on behalf of the User. The User is entitled to cancel the Transport Service by emailing Portugal Trips at least 24 hours before the confirmed time of departure with a full refund. Neither the User nor the Traveller is entitled to any refund if the cancellation of the Transport Service is made less than 24 hours before the confirmed time of departure or if the Traveller does not use the Transport Service (unless the Transport Service was not available due to the responsibility of the Driver or Portugal Trips.
The following applies to cash payments: If the User cancels the Transport Service less than 24 hours before the confirmed time of departure or if the Traveller does not use the Transport Service (unless the Transport Service was not available due to the responsibility of the Driver or Portugal Trips), the User shall in any event pay the full fee for the Transport Service booked immediately after having been notified for such payment by Portugal Trips.

TRANSPORT:
Portugal Trips or the Driver on its behalf shall contact the User in order to agree the detailed pick-up location of departure well in advance of the confirmed departure time. The User (either directly or on behalf of the Traveller) concludes the Transport Service agreement after (i) confirmation of the booking and (ii) the day trip by informing the User of the name of the Driver. Portugal Trips provides the transport services as a service within the scope (and in accordance with the Portuguese laws), of land transport, urban and suburban, of passengers, occasional transport of passengers in light vehicles, other various passenger land transport, tour operators’ activities, and other reservation services and related activities; organisation of tourist entertainment activities of irregular transport between various destinations based on prior reservation by the User.
Cancellation by the Traveller: If the Driver does not show up within 15 minutes after the agreed time, the Traveller must call Portugal Trips to notify the delay. If Portugal Trips does not arrange the Driver or alternative transport within an additional 30 minutes of such call, the Traveller may cancel the Transport Service by calling Portugal Trips informing them of the cancellation. In this case Portugal Trips will refund the full price paid for such cancelled Transport Service within 8 days of cancellation.
Cancellation by the Driver: Travellers must be at the agreed pick-up location and time. If Travellers are not ready to depart on a journey within 30 minutes after the agreed time (regardless of the reason), the Driver may cancel the Transport Service by leaving the agreed pick-up location without any right to a refund from the User or the Traveller.

Timetable and Arrivals: The Drivers shall use their best efforts to arrive at the destination (and sights, if booked) at the scheduled time. Neither the Driver nor Portugal Trips can give any guarantee to the Users about the exact time of arrival at the destination or sights.

Limitation of liability: Portugal Trips will not be liable for any loss or damage during the Transport Service caused by the Travellers. The liability of the Driver and Portugal Trips for any loss or damage resulting from the Transport Service shall be limited to the amounts insured by the Compulsory Insurances of the activity.

Rules of Conduct: Travellers must act reasonably and with good manners during the journey and not interfere with driving. Travellers must take reasonable care not to damage or dirty the car. Travellers may only take pets into the car if this is previously communicated to Portugal Trips and agreed with Driver, respecting the legislation in force.

USE OF THE PLATFORM:
A User must not alter any part of the Platform without the prior written consent of Portugal Trips whilst all rights are reserved in relation to any registered and unregistered trademarks, copyrighted work or other intellectual property appearing on the Platform. The Platform or any part of the Platform may not be reproduced or exploited for any commercial purpose without the prior written consent of Portugal Trips. No person has the right to systematically extract any part of the content of the Platform without the prior written consent of Portugal Trips.

THIRD PARTY PLATFORMS:
Where Users access the Booking Service through a Third Party Platform, additional terms may apply to the contract between the User and the operator of the Third Party Platform and to the payment services used by or provided by the Third Party Platform. In relation to Booking Services and Transport Services, these Portugal Trips Terms of Use prevail over any Third Party Platform terms.

GOVERNING LAW:
These Terms of Use, the agreement on Booking Services between the User and Portugal Trips and the agreement on Transport Service between the Driver and the Traveller or User shall be governed by Portuguese law.
